Description

The COVID-19 pandemic caused many employers to temporarily lay-off employees or significantly reduce compensation packages to stay afloat.  In many cases, employees claimed these changes constituted a constructive dismissal and sued for damages.

We are now beginning to see cases from our courts to consider the issue of constructive dismissal in the context of COVID-19.  Join us in this webinar to discuss recent cases on the following topics:

  • Constructive Dismissal for COVID-19 Reasons: When will a COVID-19 related change to terms and conditions of employment breach the employment relationship?
  • Infectious Disease Emergency Leave: In Ontario, can an employee deemed to be on Infectious Disease Emergency Leave still claim constructive dismissal at common law?
  • Canada Emergency Response Benefit (CERB) and Damages:  Can CERB collected by an employee reduce the potential damages owed by an employer?
